Ref. :—1. G.O.Ms.No. 778, Finance Department, Dt. 4-7-1958.

Order :—According to the procedure prescribed in the G.O. first read above, leave can be sanctioned to Government servants in Foreign Service in India only on receipt of an eligibility report in respect of leave and leave salary from the Accountant- General. 1 The leave salary of Gazetted Officers is paid through the Treasury on the authority of the Accountant-General on production of Last Pay Certificate issued by the Foreign Employer at the time of his going on leave. The leave salary of Non-Gazetted Officers is, however, paid by the Head of the Office on the basis of Certificate issued by the Foreign Employer. Compensatory Allowances during leave are paid by the Foreign Employer. On the expiry of leave, if the Government servant rejoins Foreign Service, the Accountant-General, in the case of Gazetted Officers and the Head of the Office, in the case of Non-Gazetted Officers, issues Last Pay Certificate after payment of leave salary to enable the Foreign employer to continue payments for the period of subsequent duty.

Above procedure has been reviewed with a view to simplifying it and thus avoiding any hardship caused to the Government servants, it is hereby ordered the following procedure for payment of leave salary to the Government servants in Foreign Service, be followed henceforth :

(i) The Foreign employer should determine the leave admissible and leave salary and payable to a Government servant in foreign service in India. For this purpose, an extract of the leave account of the Government servant should be furnished to the foreign employer at the time of his transfer to foreign service, by the Accountant-General in respect of Gazetted Officers and by the Head of Office in respect of Non-Gazetted Officers.

(ii) A copy of the orders sanctioning leave by the foreign employer should be endorsed to the Accountant-General in respect of Gazetted Officers and to the Head of the Department/Office, for Non-Gazetted Officers.

(iii) The leave salary will, initiating, be paid by the foreign employer, and will be reimbursed to him by Government (by the Accountant-General in the case of Gazetted Officers and by the Head of the Parent Department in the case of Non-Gazetted Officers). To avoid unnecessary scriptory work at all levels, the claims for reimbursement should be made by the foreign employer half-yearly for the period April to September and October to March. While sending the claims to the Accountant-General/ Head of Department concerned, the foreign employee should give the name and designation of the Government servant, nature and period of leave sanctioned, reference to number and date of sanction, rate of leave salary and amount of leave salary paid.

(iv) On receipt of claims from the foreign employer, the Accountant-General/ Head of Department should verify the claims and arrange to reimburse the amount by means of a Bank Draft within a month of receipt of the claim. The expenditure will be debited to the Head of Account to which the leave salary is debitable.
