[ G.O.Ms.No. 278, Fin. (Pay Commission) Dept., Dt. 9-6-1972 ]
Ref. :—1. U. O. Note No. 808/PC/69-1, Finance (Pay Commission) Department, Dt. 26-7-1969.
From the Accountant General, A.P., Hyderabad, Letter No. GAD 18/M, 21/1219 to 1223, Dt. 19-1-1971, addressed to the Secretary to Government, Health Department and copied to Finance Department.
From the Director of Medical and Health Service, Letter No. 17495/ Order : —According to the orders in force the pay of a person appointed to the selection grade, shall be limited to the pay drawn by his senior in the promotional post, if the pay of the senior in the higher post happens to be less than the minimum of the selection grade pay of the lower post. A question has been raised as to what pay should be allowed to a person, working in the selection grade post, on promotion to a higher post. Government have examined the matter and issue the following tentative orders which are likely to be revised from the date of this order as mentioned in para 4 below and it is hereby made clear that the following are purely tentative orders that are likely to be revised and the financial and other benefits accruing from this are also only tentative, subject to the revisions that may be made later by Government.
As per Note 3 to F.R. 22, the pay drawn by a Government servant in an officiating post is deemed as substantive pay for the purpose of fixation of pay on appointment to a higher post, if the Government servant is an approved probationer in the post, and has put in a continuous service of more than 3 years in that post, and that the delay in his confirmation is not due to any fault on his part. Government servants are eligible for appointment to the selection grade posts only after putting in a regular service of more than 5 years in the said posts. In view of the fact that Government servants are required to put in a regular service of more than 5 years of service for being eligible for appointment to the selection grade, and as the selection grade posts are not different from the ordinary grade, it is considered that the pay drawn in the selection grade post be treated as substantive pay for the purpose of fixing of pay on appointment to a higher post. The Government accordingly direct that the pay drawn by a Government servant in a selection grade post, shall be treated as substantive for the purpose of fixation of pay on appointment to a higher post, subject to the condition that when the pay of a person in the selection grade post is restricted to the pay drawn by his senior in the higher post, the pay of the person promoted from the selection grade post to the higher post shall also be restricted to the pay drawn by his senior in the higher post.
The Government also order that, where there are a number of feeder units/categories to a higher post, and promotions to the higher post are made on the basis of integrated seniority list of persons from the feeder units/categories the pay of a person appointed to the selection grade in any of the feeder units/categories shall be limited to the pay drawn by the juniormost person acting in the higher post irrespective of the feeder unit/category from which he has been promoted to a higher post, if the pay drawn by him in the higher post happens to be less than the minimum of the pay of the selection grade scale of the post in the feeder unit/category.
The Government propose to make a review of the existing system of selection grade posts, after duly taking into account the various problems arising thereby. Pending such a review, the orders in the above paragraphs will give no permanent right to the pay-fixation benefits made in accordance with these orders and the pay fixation benefits derived by those orders are subject to revision, if any which may be found necessary after the review mentioned above.
