[G.O.Ms.No. 78, Fin. & Plg., Dt. 24-2-1994]
Order :—According to the Service Rules governing the posts of Typists/ Junior Stenos/Typists-cum-Assistants/Senior Stenos/ Asst. Section Officers/ Section Officers, in the Departments of Secretariat, there exists a provision for appointment by transfer of Government servants working in the Heads of Departments in the posts of Typists/L.D. Stenos/Jr. Assistants/U.D. Stenographers/Senior Assistants/ Superintendents respectively under 12½% quota.
2. Consequent on their selection and appointment by transfer to the said posts from the posts in Heads of Departments the fixation of pay of such employees arises. No guidelines nor any orders were available in this regard. Since there are two categories of employees i.e., (i) employees holding the posts of ordinary grade pay scales and (ii) employees holding the posts of Special Grade and Special Promotion post scales, working in Heads of Departments and selected for appointment by transfer, it has become necessary to issue orders evolving the method to be adopted in fixing the pay in the posts in the Departments of Secretariat.
Regarding the employees holding their original posts i.e., working as Typists/L.D. Stenos/Jr. Assistants/U.D. Stenographers/Senior Assistants/Superintendents in the Heads of Departments when selected for appointment to the posts of Typists/L.D. Stenographers/Assistants/Senior Stenographers/ Assistant Section Officers and Section Officers respectively in the Departments of Secretariat there is no hitch in the fixation of pay in the scales applicable to the posts in the Departments of Secretariat, under the existing rules governing the fixation of pay.
As regards the employees who are holding the Special Promotion Posts in their parent Departments and selected for appointment in the said posts in the Departments of Secretariat, on the request of the employees sought orders whether their pay may be fixed in terms of the provisions of FR 22(a) read with FR 22-B depending upon their options.
The above issue has been considered and since there is no bar for appointment of the employees who are holding the posts of Special Grade and Special Promotion Post I of Typists/L.D. Stenographers/Junior Assistants and those who are holding Special Promotion Post I scale of Senior Assistants in the Heads of Departments and drawing pay in higher scales of pay, to the posts of ordinary grade of Typists/L.D. Stenographers/Assistants and Assistant Section Officers carrying the lower scale of pay in the Departments of Secretariat, it has become necessary to examine as to how the pay has to be fixed and as to what scale of pay, they will be eligible consequent on their appointment under 12½% quota.
After taking into consideration of all the aspects and after thorough examination of the issue in question, Government hereby order that the pay of employees who are holding the posts and enjoying the benefits under Automatic Advancement Scheme introduced in G.O.Ms.No. 117, Finance and Planning (FW.PRC.-I) Department, Dt. 25-1-1984 and in G.O.Ms.No. 290, Finance and Planning (FW.PRC.-I) Department, Dt. 22-7-1993, in their parent departments consequent on their selection and appointment by transfer under 12½% quota to the posts of L.D. Stenographers/Typists/Typist-cum-Assistants/ Assistant Section Officers in the Departments of Secretariat shall be fixed in terms of the provisions laid down under FR 22(a)(i) only by protection the scale of pay in which they were drawing their pay (i.e., Rs. 950-1670; 1100-2050 and 1330-2630 in the pre-revised scales of 1993 and corresponding Revised Pay Scales of 1993) prior to their transfer to Secretariat Service. They shall continue to draw that scale of pay as personal to them till such time they get promotion to higher post in their turn in the Departments of Secretariat, on the analogy of the benefit allowed to those who are appointed to Special Promotion Post Scale II and on promotion to 1st level post after enjoying the benefit of Special Promotion Post Scale II as envisaged in G.O.(P).No. 2, Finance and Planning (FW.PRC.-I) Department, Dt. 4-1-1988.
These orders shall come into force w.e.f. 1-4-1981 and the cases already settled need not be reopened.
The Departments of Secretariat are requested to take action accordingly.
