[G.O.Ms.No. 219, Finance (FRI), Dt. 15-7-1970]
Order : —The question whether a temporary Government employee appointed to a particular post under emergency provision in a Department and selected for regular appointment to the same category or post in the same service (such as Secretariat Service, Ministerial Service, Judicial Ministerial Service etc.), in some other Department, could have his temporary service counted for fixation of pay etc., on his appointment in the new Department has been under consideration of Government for sometime past.
In as much as the orders issued in G.O.Ms.No. 506, General Administration (Service-A), Dt. 21-4-1961 provide for grant of increments to a Government servant for the satisfactory temporary service rendered by him in category or class of a post in a service, it is considered reasonable that the pay last drawn by such employee should be protected under Fundamental Rule 27 if he is selected for regular appointment to the same or identical post in the same service, provided the period between the relinquishment of the temporary appointment and the joining duty in the new post does not exceed the actual journey time required, if any, for joining the new post.
Government accordingly direct that Government servant holding a temporary post when selected for regular appointment in a different office or department in the same category of post or an identical post in the same service be allowed under Fundamental Rule 27 pay in the new post taking into account his temporary service in the old post, provided that the period, if any between the date of relief from the temporary post and the date of his joining to the new post does not exceed the actual journey time required for joining the new post.
