Order :—In the Circular Memo. 3rd cited orders were issued to the effect that the benefit of adjustment of pay of the seniors under F.R. 27 mentioned in G.O.Ms. No. 229, Finance, Dt. 31-8-1965 be extended to other categories of posts covered by paras 12 and 13 of the Two Men Committee Report provided that the criteria prescribed in the above mentioned paras of the report is fulfilled, viz., both the juniors and seniors in the same category should have been actually working in that category on the crucial dates viz., 31-10-1958 and 1-1-1964. The monetary effect of this benefit was allowed with effect from 1-1-1964 in Government Circular Memo. No. 17296-A/200-A/FR III/69, Dt. 18-4-1969 and extended to the Telangana employees also in Finance Circular Memorandum No. 30400-A/382/FR. III/69, Dt. 11-7-1969.
The Board of Revenue (Land Revenue) in its letter 6th cited stated that the criteria prescribed originally for the employees to be entitled to the benefit of para 13 of the recommendations of the Two Men Committee, viz., that the U.D.Cs., of the Heads of Departments should have acted in the category on 31-10-1958 and 1-1-1964 was relaxed in G.O.Ms.No. 216, Finance (PC), Dt. 16-1-1965 and the benefit was extended in para 3(b) of the said G.O. to the officers of Heads of Departments to the Andhra employees appointed prior to 11-1-1958 as L.D.Cs./Typists/Steno-Typists and promoted as U.D.Cs. and U.D.Cs. as Superintendents during the period from 1-11-58 to 31-10-1961 and working as such on 1-1-64. It has further stated that this latter concession escaped the notice of the Government while issuing orders in Circular Memo. No. 88133-A/1709/FR. III/67, Dt. 24-1-1968 extending the benefit of adjustment of pay of the seniors under F.R. 27 to other categories of post covered by paras 12 and 13 of the Two Men Committee report and that the intention of the Government in issuing orders in the above Circular Memo. is to extend the benefit of the pay fixation under F.R. 27 to the senior employees on pay with that of his junior who gets the benefits of paras 12 and 13 of the recommendations of the Two Men Committee by virtue of satisfying the criteria fixed for this benefit in the various Government orders issued from time to time and requested that the criteria fixed in Circular Memo. No. 88133-A/1709/FR. III/67, Finance, Dt. 24-1-1968 for extension of the benefit of pay fixation of senior under F.R. 27 on par with his junior may be modified suitably.
The Board of Revenue while giving illustration of certain cases, has stated that Andhra Pradesh employees working prior to 1-11-1958 to 31-10-61 and working as such on 1-1-1964 have been made eligible for the benefit of increase in pay recommended by the Two Men Committee in paras 12 and 13 of the said report and implemented in G.O.Ms.No. 216, Finance (PC), Dt. 16-8-1965. In accordance with para 3(b) of the said G.O. the condition of crucial date viz., 31-10-1958 to derive the benefit of fixation of pay of the seniors on par with juniors is not insisted upon in cases of Andhra Personnel who were promoted as U.D. Clerks after 1-11-1958 (i.e., for the persons promoted during the period from 1-11-1958 and 31-10-1961). But the Telangana clerks who have been promoted as U.D.C. after 1-11-1958 even earlier than the juniors (i.e., Andhra Clerks) and who got the benefit of G.O.Ms.No. 216, Finance (PC), Dt. 16-8-1965 stand to disadvantage of drawing lesser pay than the juniors for the reasons that their pay has not been protected under F.R. 27, implementing the formula of the crucial date viz., 31-10-58.
As the above issues escaped notice while issuing orders in Circular Memo.No. 88133 A/1709/FR.III/67, Finance (FR.III), Dt. 24-1-1968, Government after careful consideration and to clear doubts, issue the following amendments to the Cir. Memo. 3rd cited by adding the following : The Cir. Memo. No. 17296-A/200-A1 FR.III/69, Dt. 18-4-69 and 30400-A/382/FR. III/69, Dt. 11-7-1969 are deemed to have been modified to this effect.
