[G.O. Rt. No. 2985, G.A. (Spl.-A) Dept., Dt. 1-8-1979]

Order :—Whenever, due to certain administrative reasons, posting orders could not be given after expiry of the leave applied for by officers belonging to the All India Services, Andhra Pradesh Administrative Service and other State Services, or on their transfer, the period during which they had to wait for posting is treated as Compulsory wait or excess joining time and orders are being issued, accordingly, by the concerned Administrative Departments of the Secretariat after obtaining the concurrence of the Finance and Planning (Finance Wing) Department.

(2) To avoid delay in the issue of the orders, it has been decided that Administrative Departments of the Secretariat be delegated powers to issue orders treating the period to the extent of 30 days during which officers have to wait for posting as Compulsory Wait or excess joining time, without reference to the Finance and Planning (Finance Wing) Department. If, however, the period of Compulsory Wait or excess joining time exceeds 30 days, the concurrence of the Finance and Planning (Finance Wing) Department should, be obtained.

(3) All the Departments of the Secretariat are further informed that as far as possible the posting orders should be issued promptly and that issue of orders of compulsory wait or excess joining time is resorted to in rare cases and it should not become a routine affair.

Delegation of powers to Departments of Secretariat — Issue of orders relating to compulsory wait upto a maximum period of 30 days by Departments of Secretariat in respect of Non-Gazetted Government employees without reference to Finance and Planning (Fin. Wing) Department.

[G.O.Rt.No. 1274, Fin. & Plg. (FW : FR-I) Dept., Dt. 26-6-1982]

Order :—In the G.O.Rt.No. 2985, General Administration (Special-A) Department, Dt. 1-8-1979, powers have been delegated to the Administrative Departments of the Secretariat to issue orders treating the period to the extent of 30 days, during which the officers belonging to the All India Services, Andhra Pradesh Administrative Services and other State Services may have to wait for posting, as compulsory wait or excess joining time, without reference to Finance and Planning (Fin. Wing) Department.

(2) As the above delegation is applicable to the Gazetted Officers only, it has been decided that similar delegation of powers may be made for issue of orders in respect of Non-Gazetted and other officers not covered by the G.O.Rt.No. 2985, General Administration (Special-A) Department, dated 1-8-1979, to avoid delay in the issue of orders of compulsory wait or excess joining time. The Government, therefore, hereby delegate powers to the Administrative Departments of the Secretariat to issue orders for treating the period to the extent of 30 days, during which such officers may have to wait for postings, as compulsory wait or excess joining time, without reference to Finance and Planning (Fin. Wing) Department. If, however, the period of compulsory wait or excess joining time exceeds 30 days, the concurrence of the Finance and Planning (Fin. Wing) Department should necessarily be obtained.

(3) All the Departments of the Secretariat are further informed that as far as possible the posting orders should be issued promptly and that recourse to the issue of orders of compulsory wait or excess joining time is resorted to in rare cases by keeping such cases to the barest minimum.

Foreign Service
INTRODUCTION

Government servants are some times deputed to work in the Departments or in posts outside the Government like Food Corporation, Universities etc. While a person is on deputation he does not cease to be a Government servant. His lien in the parent Department continues, unless he gets himself absorbed in the Department or concern to which he has been deputed. But so long as his status as a deputationist continues all his rights in the parent Department are protected. General Rule 9 lays down that the absence of a member of a service from duty in such service whether on leave or on foreign service or on deputation shall not, if he is otherwise fit, render him ineligible on his turn for re-appointment to a substantive or officiating vacancy or for promotion from a lower to a higher category in such service. Thus the rights of a deputationist are protected in the parent department.

Continuation of deputation :—Continuation of deputation of the officers may be sanctioned subject to the following conditions :—

(1) In the Government orders sanctioning the further continuance of the deputation of individual officers, the Government Order in which the original terms of deputation have been approved should be indicated;

(2) Before approving proposals for further continuance of deputation, it should be ensured that the terms of deputation originally agreed to remain unaltered:

(3) If there are changes in any of the terms of deputation, the concurrence of the finance department should be obtained before sanctioning the proposals for further continuance of deputation.
